Landlord/Tenant

Landlord/Tenant disputes are proceedings to recover possession of premises and/or obtain a money judgment up to $25,000.

The 45th District Court hears cases when the premises are located in Oak Park, Huntington Woods, Pleasant Ridge and the Charter Township of Royal Oak. For money judgments exceeding the Court's $25,000 jurisdiction, the District Court will only determine the issue of possession, and the Circuit Court will determine the money portion.

Note:

Landlord/Tenant Forms may be purchased at the court's civil counter for $1.00 per form. You can also find them at https://www.courts.michigan.gov/SCAO-forms/LTLC-forms/

Filing Fees may be paid by case, check, money order, Visa, MasterCard, or Discover. Checks or money orders should be made payable the 45th District Court and may be mailed or turned in at the civil window at the court. Credit card payments must be made in person at the cashier's window.

The court will provide a court officer for service of the summons and complaint upon request. Only our bonded court officers ma execute evictions. You are responsible for all service fees incurred and my be billed by the court officer. If you would like the court to forward your documents to an appointed court officer for service, a separate service fee is required. Please contact them regarding the cost prior to filing your lawsuit with the court. Do not remit court officer fees to the court. If you are mailing in your filing, please indicate which court officer you have selected, however, you must pay them directly.
